What percentage of the time would you say charges are filed after a warrant has been served and executed?
I know this is a different circumstance and there’s wayyy more that we don’t know than we do… just genuinely interested in the legal side of this as much as I am the circus side of it.
For me and the type of LE I do, I'd say no less than 90% of the time. Of course if I'm filing for a search warrant, I'm pretty damn positive that what I'm looking for is where I believe it is...not a fishing expeditions.
Also, unless I can show in the request that I reasonably believe that a crime was committed (PC), then I can't get the search warrant anyway.
By comparison, my cases are much less complex than this one. Kiddie porn on a computer or drugs/weapon used in a crime/stolen property at the listed location. Fairly cut and dry. This case isn't as cut and dry. I'd say we're 50/50 on charges being filed in Trump's case. Just my guess.
Also, and you might find this interesting, I make sure to include the smallest item that I reasonably believe I might find on the warrant that is related to the case. For example, if I'm looking for a gun, I'll list the bullets for that gun as well.
How does that help? Well, if I'm looking through a tiny drawer for a big gun that won't fit in that drawer, whatever I find would be thrown out because if I'm looking in that tiny drawer, I'm clearly not looking for that big gun. If I list the bullets, that drawer is now in play. And if I find something else illegal in that tiny space, like drugs for example, I can charge them for it.
